Care cases must be withdrawn / joy over the judgment of the Higher Regional Court of Frankfurt  

"We are pleased about the clear judgment of the Higher Regional Court of Frankfurt against the local lateral thinker Imke Otto", says the parliamentary committee of the Greens Main-Kinzig, Reiner Bousonville, Viola Haßdenteufel and Jakob Mähler. Last Wednesday, the Higher Regional Court rejected the preliminary injunctions of the initiator of ‘Allianz pro Grundgesetz’ for alleged defamatory statements against the chairmen of the association ‘Hand aufs Herz’, Julia Hott and Alex Schopbach: ‘This clearly shows that the jurisdiction is also behind the clear words that are necessary in these times.’

The subsequent statement by the lateral thinker group that the court had declared it ‘bird-free’ was appalling: "This shows once again the distortion of the facts and the incorporation of history and symbolism, which is characteristic of the lateral thinker group “Alliance pro Grundgesetz”", said the parliamentary group executive.

In the regular demonstrations against the corona measures, Hanau lawyer Holger Fischer also takes the lead. The district parliamentary group is now reacting with great alarm to a report by the Hessenschau, according to which Fischer is said to have refused the necessary coronavirus vaccinations to two persons entrusted to him for legal care.

Fischer has been commissioned for many years by the district court of Hanau and the administrative authority of the district as a legal guardian for adults who are unable or no longer able to carry out their personal legal transactions independently and independently. According to the report of the Hessenschau, he is currently alone legally responsible for 79 care cases, for which he bears a high responsibility as a legal guardian and must always take into account the well-being of his clients through permanent and regular contact.

"The fact of entrusting 79 people in the Main-Kinzig district to the Hanau lawyer Holger Fischer, who is one of the leading minds in the lateral thinker movement in the Rhine-Main area and has been noticed because of cases of vaccination influence, must be fundamentally questioned," said Bousonville, Haßdenteufel and Mähler.

According to the Hessenschau report, Fischer has around 26,000 followers at Telegram and speaks about the coronavirus vaccination of ‘genocide’ and calls for the state to ‘lame’. The lawyer wrote in Telegram about politicians: “Either you have killed us by then with your actions and your injections, or you yourself have become their victim. Directly or indirectly.’ 

"These statements are unacceptable for a lawyer who looks after 79 people", said the Group Bureau. "While it is to be welcomed that the Hanau District Court has decided not to award Fischer new mandates for legal support, it is imperative that the district and district court provide a solution to the still existing support mandates and work out whether there have been and are still other cases of vaccination control. The statement by the district that Fischer should no longer be proposed as a professional adviser is not sufficient here.’ The Green Group supports the statement by the Mayor of Hanau, Claus Kaminsky, to report the case to the Bar Association and, if necessary, to file a complaint against Fischer if it has not yet been submitted: ‘These are clear words that the circle here once again misses in relation to the activities of lateral thinkers.’  

For the group executive, the responsible health care no longer appears to exist in the care cases of lawyer Fischer, which is based on his person and the handling of the tasks assigned to him for the care court: ‘In this case, there is the possibility of requesting supervision. This should not only be demanded by the supervised persons and their relatives, but above all by the competent supervising court in cooperation with the supervising authority of the district. They must ensure that the ongoing care cases are withdrawn so that the vulnerable and dependent persons are always well cared for and included in the vaccination decision, taking into account their free will. But it would probably be best to find new carers for the almost 80 people as soon as possible", concludes Bousonville, Haßdenteufel and Mähler.
